Terms of Use
Important points
The Services provide sports education, planning, training support, products, and program access. AI content can be wrong and must be reviewed by a qualified adult. The Services do not provide medical diagnosis or emergency advice. Accounts and purchases for minor athletes must be managed by an authorized adult.
These Terms do not replace any separate facility waiver, participation agreement, custom-product approval, team agreement, or program-specific policy.
1. Acceptance of these Terms
These Terms of Use ("Terms") are a binding agreement between you and CC Athletics Group ("CC Athletics," "we," "us," or "our"). They govern your access to and use of:
- ccathleticsgroup.com and related pages;
- the CC Athletics Coach mobile application, including successor versions or branding;
- AI tools, accounts, digital workbooks, practice plans, uploaded-content features, messages, registrations, scheduling, subscriptions, memberships, purchases, and support; and
- online components of Curl's Corner Hitting Lab, Clutch Catch, Lab Rats, camps, clinics, lessons, team partnerships, and other CC Athletics programs.
These are collectively the "Services." By accessing or using the Services, creating an account, selecting "I agree," or making a purchase, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Additional terms displayed for a specific product, subscription, program, event, team, facility, or transaction are incorporated into these Terms. If a specific written agreement conflicts with these Terms, the specific agreement controls for that subject.
2. Eligibility, minors, and adult responsibility
- You must be at least 18 years old and legally capable of entering a contract to create a paid account, purchase a subscription, register a minor, accept a waiver, or upload content about a minor.
- A person under 18 may use the Services only with permission and active supervision from a parent or legal guardian, or through an authorized coach-managed account.
- A child under 13 may not create an independent account or directly submit personal information. A parent or legal guardian must manage the account and any information or content concerning that child.
- Coaches, team administrators, and other adults who submit information about an athlete represent that they are authorized to do so and have obtained all required parent or guardian permissions.
The adult who creates or manages an account for a minor is responsible for that minor's use of the Services and for reviewing all recommendations before the minor follows them.
3. Accounts, credentials, and mobile-app license
You must provide accurate information, keep it current, protect login credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account unless prohibited by law.
Subject to these Terms, CC Athletics grants you a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable license to install and use the App on devices you own or control for your personal, family, or authorized internal team use. You may not copy, sell, rent, lease, distribute, reverse engineer, decompile, modify, create derivative works from, or bypass security or access controls for the App except where applicable law expressly permits it.
Apple, Google, or another app marketplace may impose additional terms. Those marketplace terms also apply to your download, purchase, and use of the App.
4. AI-generated and educational content
The Services may generate baseball or softball answers, practice plans, drills, player-development ideas, video or image observations, equipment suggestions, rule explanations, and other educational material using artificial intelligence or automated systems.
- AI output may be incomplete, outdated, inaccurate, or inappropriate for a particular athlete.
- You must independently review output and use reasonable judgment before relying on it.
- League rules, field dimensions, bat standards, eligibility rules, pitch-count limits, and safety requirements vary. Confirm them with the applicable league, school, tournament, governing body, manufacturer, or qualified official.
- No output guarantees athletic improvement, playing time, team selection, scholarship, recruiting interest, injury prevention, or any other result.
- Do not use the Services to make emergency, medical, legal, or other high-stakes decisions.
CC Athletics may modify, filter, refuse, or remove prompts or outputs to protect safety, enforce these Terms, or improve service quality.
5. Physical activity, safety, and medical disclaimer
Not medical advice
The Services do not diagnose injuries, prescribe rehabilitation, or replace a physician, physical therapist, certified athletic trainer, or other licensed healthcare provider.
Baseball, softball, strength training, throwing, pitching, hitting, speed work, and other physical activities involve risk of injury. Before beginning a program, the athlete and responsible adult should consider the athlete's age, health, experience, equipment, environment, workload, and guidance from qualified professionals.
Stop activity and seek appropriate medical attention if an athlete experiences pain, dizziness, shortness of breath, weakness, numbness, head-injury symptoms, or another concerning condition. In an emergency, call 911 or the applicable emergency service. Do not rely on the App for emergency assistance.
Participation in an in-person activity may require a separate liability waiver, health form, facility agreement, or informed consent. These Terms do not replace those documents.
6. User content and permissions
"User Content" means prompts, messages, photos, videos, audio, documents, athlete information, feedback, reviews, and other material you submit through the Services.
You retain ownership of your User Content. You grant CC Athletics a worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, transmit, display, and process User Content only as reasonably necessary to operate, secure, support, and improve the Services; provide requested AI or analysis features; comply with law; and enforce these Terms.
You represent that:
- you own the User Content or have all rights and permissions required to submit and use it;
- the User Content does not violate privacy, publicity, intellectual-property, contractual, or other rights;
- when User Content identifies or depicts a minor, you are the parent or legal guardian or have documented authorization from the parent or legal guardian; and
- you will not upload private team footage, scouting information, medical information, or another person's personal data without authority.
We may remove or restrict User Content that violates these Terms or creates safety, privacy, legal, or operational risk.
7. Prohibited conduct
You may not use the Services to:
- break the law, violate another person's rights, or encourage unsafe, abusive, discriminatory, threatening, or exploitative conduct;
- harass, groom, intimidate, or inappropriately contact a minor;
- submit sexual content involving minors, exploitative content, or content depicting abuse;
- impersonate another person, misrepresent authority, or submit false eligibility, registration, discount, or payment information;
- upload malware, interfere with operations, probe security, bypass access controls, scrape content, use unauthorized bots, or overload the Services;
- copy, publish, resell, sublicense, or commercially exploit CC Athletics content, workbooks, plans, brand assets, or App features without written permission;
- use output to build or train a competing product or to create a misleading endorsement; or
- use the Services in a way that could harm an athlete or substitute automated output for appropriate adult supervision.
8. Prices, payments, subscriptions, and refunds
A. General payment terms
Prices, benefits, taxes, billing intervals, renewal terms, and program commitments are shown at checkout or on the applicable offer page. You authorize the applicable payment processor or app store to charge the selected payment method.
B. App subscriptions and digital purchases
Subscriptions or digital purchases made through Apple or Google are billed and managed by the applicable app store. Unless the offer states otherwise, subscriptions automatically renew until canceled through the user's app-store account settings. Deleting the App or deleting a CC Athletics account does not automatically cancel an app-store subscription. Refund eligibility for app-store purchases is determined by the applicable store and law.
C. Website memberships and fixed-term programs
A recurring website membership continues until canceled under the instructions provided at purchase. Cancellation applies prospectively and must be completed before the next renewal to avoid the next charge. Except where required by law or expressly stated otherwise, charges already processed are not retroactively refunded.
When a player-development program, team agreement, or other service is advertised as a fixed-term commitment, selecting monthly installments does not convert it into a month-to-month agreement. The full stated commitment remains due unless a written exception applies.
D. Refunds, missed services, and changes
Specific cancellation, rescheduling, credit, and refund terms shown on a program page, registration form, checkout page, invoice, or written agreement control. Except where required by law or expressly stated otherwise:
- digital content is nonrefundable after access or delivery;
- custom products are nonrefundable after design approval or production begins;
- missed appointments, classes, camps, clinics, practices, and no-shows are not automatically credited or refunded; and
- membership benefits, unused sessions, or discounts do not carry over unless the applicable offer expressly says they do.
We may correct pricing errors before fulfillment and may cancel and refund an order we cannot fulfill.
9. Programs, facility access, events, discounts, and custom products
A. Camps, classes, lessons, teams, and events
Schedules, instructors, locations, activities, age groups, and program content may change because of weather, enrollment, facility availability, safety, staffing, or circumstances outside our control. We may combine, reschedule, relocate, substitute, or cancel a session when reasonably necessary. Any remedy will be governed by the program-specific policy and applicable law.
Participants must follow staff instructions, posted facility rules, equipment requirements, codes of conduct, supervision requirements, and pickup or access procedures. We may remove or suspend a participant whose conduct is unsafe, disruptive, abusive, dishonest, or harmful.
B. Facility and 24/7 access
Facility access is personal and may not be shared. Minors must comply with guardian-supervision rules. Users must secure doors, use equipment only as authorized, report damage or unsafe conditions, and avoid entering restricted areas. Access may be suspended for safety, maintenance, nonpayment, misuse, or violation of facility rules.
C. Eligibility-based discounts
A user claiming an i9, membership, team, nonprofit, promotional, or other eligibility-based price must satisfy the stated requirements and provide reasonable proof when requested. We may adjust or cancel an improperly claimed discount.
D. Clutch Catch and other custom products
Customers are responsible for reviewing and approving names, spelling, colors, logos, sizes, handedness, materials, web style, embroidery, and other specifications before production. Display colors, leather grain, stitching, and handmade details may vary from screens, samples, or renderings. Production and delivery dates are estimates unless expressly guaranteed in writing. Separate written warranties or return terms supplied with a product control.
10. CC Athletics intellectual property
The Services and all related software, designs, text, graphics, logos, videos, drills, workbooks, manuals, diagrams, databases, trademarks, service marks, and other content supplied by CC Athletics are owned by or licensed to CC Athletics and are protected by intellectual-property laws.
These Terms do not transfer ownership. You may use purchased or accessed content only for personal, family, or authorized internal team use. You may not reproduce, post publicly, distribute, sell, create competing materials from, remove notices from, or otherwise exploit protected content without written permission.
Feedback and suggestions may be used by CC Athletics without restriction or compensation, provided we do not publicly identify you without permission.
11. Third-party services and links
The Services may link to or integrate with app stores, payment processors, scheduling tools, forms, maps, social-media platforms, AI or cloud providers, and other third-party services. Their own terms and privacy policies govern their services. CC Athletics is not responsible for third-party content, availability, security, decisions, or practices.
12. Disclaimers, limitation of liability, and indemnification
A. Disclaimer of warranties
To the maximum extent permitted by law, the Services are provided "as is" and "as available." CC Athletics disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and uninterrupted or error-free operation. We do not warrant that AI output, training content, product recommendations, or program results will be accurate or suitable for a particular athlete.
B. Limitation of liability
To the maximum extent permitted by law, CC Athletics and its owners, employees, instructors, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, opportunities, data, or goodwill; or damages arising from reliance on AI output, unauthorized account access, third-party services, or inability to use the Services.
To the maximum extent permitted by law, the total aggregate liability arising from the online Services will not exceed the greater of (a) the amount you paid CC Athletics for the applicable online Service during the twelve months before the event giving rise to the claim or (b) $100. This online limitation does not replace or expand any rights or obligations in a separately signed facility or participation waiver.
Some jurisdictions do not allow certain exclusions or limits, so some provisions may not apply to you. Nothing in these Terms excludes liability that cannot legally be excluded.
C. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless CC Athletics and its owners, employees, instructors, contractors, affiliates, licensors, and service providers from claims, losses, liabilities, and reasonable costs arising from your User Content, misuse of the Services, violation of these Terms, violation of another person's rights, or lack of authority to submit information about a minor.
13. Suspension, termination, and account deletion
You may stop using the Services at any time. You may request account deletion through the App's account settings when available or by emailing ccathleticsgroup@gmail.com.
We may suspend, restrict, or terminate access when reasonably necessary because of nonpayment, misuse, fraud, safety concerns, legal requirements, technical risk, or violation of these Terms. Provisions that by their nature should survive termination—including payment obligations, ownership, licenses needed to process prior User Content, disclaimers, liability limits, indemnification, and governing law—will survive.
14. Governing law and disputes
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Before filing a formal claim, the parties agree to make a good-faith effort to resolve the issue by written notice and direct discussion.
Unless applicable law requires otherwise, a legal action relating to these Terms or the online Services must be brought in a state or federal court located in Franklin County, Ohio, and each party consents to that court's jurisdiction and venue.
15. Changes, severability, and entire agreement
We may update these Terms as the Services or legal requirements change. The revised Terms will be posted with a new effective date. Continued use after the effective date constitutes acceptance where permitted by law; when required, we will request affirmative agreement.
If a provision is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and any applicable specific written agreement form the entire agreement concerning the online Services.
